These Terms of Use ("Terms") govern your access to and use of the Attractiveness AI website, applications, subscriptions, APIs, and related services (collectively, the "Services"), operated by DataDolphin PTE. LTD. ("we," "our," or "us"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Attractiveness AI provides AI-powered facial analysis and attractiveness assessment services, including:

• Facial feature analysis and scoring
• Facial landmarks, face mesh, age estimation, attractiveness analysis, and complete face reports through our API
• Personalized improvement recommendations
• Style and photo optimization suggestions

3. User Accounts

3.1 Account Registration

To access certain features of our service, you must register for an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the service or other users

3.3 Usage Restrictions

We monitor usage patterns to ensure fair access to our service for all users. We reserve the right to:

• Restrict or limit access for accounts with excessive usage that may impact service performance
• Implement rate limiting or temporary suspension
• Require upgraded service plans for users with consistently high usage volumes
• Permanently suspend accounts that engage in abusive automation or use automated access outside our authorized API

What constitutes "excessive usage" will be determined at our sole discretion based on factors including but not limited to: frequency of requests, volume of data processed, and impact on system resources. We will make reasonable efforts to notify users before implementing restrictions when possible.

4. User Content and Conduct

4.1 Photo Submissions

When submitting photos or other content for analysis through the website, applications, or API, you:

• Must own or have rights to the photos
• Must not submit photos of minors without parental consent
• Must not submit inappropriate or offensive content
• Grant us limited rights to process the photos for analysis
• Must provide all notices and obtain all permissions or consents required by applicable privacy, biometric-data, and other laws

4.2 Prohibited Activities

You agree not to:

• Use the service for any illegal purpose
• Attempt to reverse engineer our AI technology
• Share, transfer, sublicense, or resell access, accounts, API credentials, or credits except with our written permission
• Upload malicious content or code
• Harass or abuse other users
• Circumvent payment, credit, trial, usage, rate-limit, authentication, or other access controls
• Create multiple accounts, use another person's credentials or payment method, exploit a vulnerability, or use deception to obtain free or discounted access
• Probe, scan, test, or exploit vulnerabilities without our prior written authorization
• Interfere with, overload, disrupt, or attempt to gain unauthorized access to the Services, accounts, servers, networks, or data

Unauthorized access, hacking, payment circumvention, theft of service, and related conduct are prohibited and may violate applicable computer misuse, fraud, or other laws. We may suspend or terminate access, preserve relevant records, recover unpaid amounts and investigation costs where legally permitted, and report suspected unlawful conduct to payment providers or law-enforcement authorities.

5. Subscription and Payments

5.1 Free Access

We may offer a free account option with limited functionality. The features and usage limits for free accounts are subject to change at our discretion.

5.2 Free Trial

We may offer a free trial period for our subscription services. If you sign up for a free trial, you will have access to premium features for a limited time. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel it before the trial ends. By starting a free trial, you agree to these terms.

5.3 Subscription Plans

Our subscription service:

• Is billed according to the billing cycle specified at purchase (monthly, yearly, or other available durations)
• Can be cancelled at any time
• Provides access to premium features
• Is non-transferable

5.4 Cancellation Policy

You may cancel your subscription at any time:

• Cancellation takes effect at the end of your current billing period
• You will continue to have access to premium features until the end of your paid period
• No refunds are provided for partial billing period usage
• Cancellation can be done through your account settings or by contacting support

5.5 Refund Policy

Our refund policy is as follows:

• Refunds are considered on a case-by-case basis
• No refunds for partial billing period usage or after service has been used, except where required by applicable law
• Refunds may be issued for technical issues preventing service use
• Refund requests must be made within 7 days of purchase
• Refunds are processed within 5-10 business days

5.6 Dispute Resolution

For any disputes regarding payments or services:

• Contact our support team first to attempt resolution
• Provide detailed information about the issue
• Allow up to 10 business days for investigation
• If unresolved, disputes may be escalated to our management team
• We reserve the right to suspend accounts during dispute investigation

6. API Services

6.1 API Access and Credentials

Subject to these Terms, your plan, and the current API documentation, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the API for your own authorized applications and business purposes. You must keep API keys and other credentials confidential, must not expose them in public or client-side code, and are responsible for requests and charges made with your credentials. You must notify us promptly if you suspect a credential has been lost, disclosed, or compromised.

6.2 API Credits and Usage

• API credits are subject to the quantity, validity period, and usage rules shown for your plan or order.
• Unused API credits expire at the end of each applicable monthly billing cycle. They do not roll over or carry forward to the next month.
• Credits are non-transferable, may not be pooled or resold, have no cash value, and are not refundable except where required by applicable law or expressly stated in writing.
• You are responsible for monitoring usage and protecting credentials from unauthorized consumption. Usage measured by our systems will control unless you demonstrate a clear measurement error.
• Requests that exceed available credits or applicable limits may be rejected, delayed, or subject to additional charges only where those charges have been disclosed and agreed.

6.3 Availability, Outages, and Maintenance

The API is provided on an "as is" and "as available" basis. It may experience scheduled maintenance, emergency maintenance, outages, errors, degraded performance, delays, or loss of connectivity. Unless we sign a separate written service-level agreement with you, we do not guarantee any uptime, response time, latency, processing time, or uninterrupted availability, and no service credits are owed for downtime.

6.4 Parallel Requests, Rate Limits, and Processing

We do not guarantee that any number of parallel or simultaneous requests will be accepted, processed concurrently, completed in the order submitted, or completed successfully. Concurrency, throughput, request-size, and rate limits may depend on your plan, system capacity, security controls, and current demand, and may change to protect the Services. We may queue, throttle, time out, or reject requests, including with rate-limit or temporary-unavailability responses. Your integration is responsible for handling timeouts, partial failures, retries, duplicate requests, and backoff safely.

6.5 API Changes and Compatibility

We may update models, endpoints, response formats, documentation, limits, security requirements, or supported features. Where reasonably practicable, we will provide advance notice of material breaking changes, but urgent security, legal, or reliability changes may take effect immediately. You are responsible for maintaining compatibility with the current documentation and supported API versions.

6.6 Responsible Use of API Results

API outputs are automated estimates and may be incomplete, inaccurate, unavailable, or inappropriate for a particular person or use case. You must review results appropriately and must not use them as the sole basis for medical decisions, identity verification, or decisions that determine a person's eligibility for employment, housing, credit, insurance, education, or essential services. You are responsible for your application, user disclosures, legal compliance, and decisions made using API outputs.

7. Intellectual Property

All content and technology associated with Attractiveness AI, including:

• AI algorithms and analysis methods
• Website design and content
• Logos and branding
• Analysis results and recommendations

are protected by intellectual property rights and may not be used without permission.

8. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee:

• 100% accuracy of AI analysis
• Uninterrupted service availability
• Any particular API uptime, latency, throughput, concurrency, request order, or processing time
• Results of any specific improvement recommendations
• Compatibility with all devices or browsers
• That the Services will be error-free, secure, or suitable for your intended use

9. Limitation of Liability

To the maximum extent permitted by applicable law, Attractiveness AI shall not be liable for:

• Indirect or consequential damages
• Loss of data, revenue, profits, goodwill, API credits, or business interruption
• Results of using our analysis or recommendations
• API outages, delays, rate limiting, rejected requests, model or format changes, or failed parallel requests
• Unauthorized use of credentials where you failed to safeguard or promptly report them
• Third-party actions or content

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the website. Continued use of the service after changes constitutes acceptance of the modified Terms.
